The Virginia Supreme Court’s May 8, 2026 ruling struck down the constitutional amendment voters narrowly approved on April 21, holding that lawmakers failed to follow required legislative procedures for placing the measure on the ballot. That decision nullified the accompanying Democratic-drawn map, which would have created ten districts favoring Democrats and one Republican-leaning seat. The U.S. Supreme Court declined emergency intervention, leaving the existing 2021 court-drawn lines in place. With candidate filing deadlines approaching and no further legal avenues open, election officials have confirmed the current districts will govern the November 2026 midterms, preserving Virginia’s 6–5 partisan split.
