Family court norms favoring maternal custody for very young children, absent clear evidence of harm, form the core driver behind the market-implied 85.5% probability against Elon Musk securing full custody of his son with Ashley St. Clair. Public records show Musk publicly acknowledged paternity in January 2026 and cited concerns over St. Clair’s statements regarding transgender issues when announcing plans to seek sole custody, while St. Clair had already petitioned for sole custody in 2025. Verified reports note Musk’s limited prior contact—only a handful of visits since the child’s September 2024 birth—which aligns with historical patterns where high-profile fathers rarely prevail in such bids. The absence of major case updates or substantiated new evidence through mid-2026 has reinforced trader consensus on these structural barriers. Proceedings remain ongoing with no imminent resolution catalysts expected.
