The strong market consensus against Elon Musk securing full custody of his son with Ashley St. Clair stems primarily from the unresolved New York family court proceedings, where St. Clair filed in early 2025 for sole legal custody and paternity recognition following the child's September 2024 birth. Public statements show competing claims—St. Clair alleging limited paternal involvement and Musk announcing plans to seek custody in 2026—yet no verified court rulings or settlements have shifted primary custody to him. Traders weigh the high legal threshold for overturning a mother's established position, ongoing public disputes, and typical family law patterns favoring stability for young children. A final ruling or major evidentiary development could still alter the outcome, though the case remains in early stages with significant uncertainty.
