Virginia voters will decide the Right to Reproductive Freedom Amendment on November 3, 2026, after the General Assembly approved the measure in consecutive sessions in 2025 and 2026 with an intervening election, followed by enabling legislation signed by Governor Spanberger. Legal challenges to ballot placement and language were dismissed by mid-2026, clearing the path for the referendum. Current state law already permits abortion through the third trimester with exceptions, and the amendment would add constitutional protections for reproductive decisions including contraception and fertility care while permitting third-trimester regulations. Trader consensus at 90.5% for passage reflects Virginia’s Democratic legislative majorities, polling trends favoring abortion access, and the typical success rate of legislatively referred measures on this topic in similar states.
