Maryland’s Democratic-controlled legislature referred Question 3 to the November 3, 2026 ballot during an August special session, seeking to exempt congressional districts from state constitutional compactness and boundary rules that apply to legislative maps. After lower courts blocked the measure over procedural deadlines and ballot language, the Maryland Supreme Court ruled on September 3 that it may appear, ordering revised wording while preserving the core change. The amendment would also authorize original Supreme Court jurisdiction over congressional redistricting challenges. With Democrats holding seven of eight U.S. House seats and a strong statewide voter base, traders assign the measure a 65% implied probability of approval, reflecting the party’s structural advantage and recent court clearance while accounting for the possibility of voter resistance or turnout dynamics in a low-profile constitutional question.
