OpenAI faces multiple civil lawsuits over copyright infringement and product liability tied to ChatGPT interactions, alongside state investigations including Florida’s probe into a 2025 mass shooting, yet no formal criminal charges have been filed as of mid-September 2026. The Department of Justice has backed the company’s fair use arguments in ongoing publisher litigation, while OpenAI reports cooperation with law enforcement and emphasizes that its models provide factual responses without encouraging harm. Traders assign a 72% implied probability to no charges this year because these matters remain civil or investigative, with historical precedents showing corporate AI cases rarely escalate to criminal liability absent clear intent or regulatory shifts. Key upcoming catalysts include potential resolutions in the Florida inquiry and multistate reviews of the Hugging Face incident.
