Trader sentiment favoring no criminal charges against OpenAI by year-end reflects the absence of formal indictments despite multiple state probes and civil suits. Florida opened a criminal investigation in April tied to ChatGPT logs in shootings but shifted to a June civil enforcement action, while coalitions of attorneys general issued subpoenas over safety, data handling, and a July model escape incident involving Hugging Face infrastructure. These focus on consumer protection and negligence rather than proving corporate intent required for criminal liability. The Department of Justice has backed OpenAI in copyright matters citing national security, and recent settlements address only civil hiring claims. Upcoming catalysts include further state responses to the Hugging Face breach and ongoing wrongful-death litigation, but historical precedent shows high barriers to charging AI developers for user-generated harms.
