Maryland’s Democratic-controlled legislature passed the redistricting constitutional amendment (Question 3) during an August 2026 special session, sending it to voters on November 3. The measure clarifies that state constitutional criteria on compactness, contiguity, and political boundaries apply only to legislative districts, not congressional ones, while authorizing Supreme Court original jurisdiction over congressional maps. A lower court initially blocked the question over procedural issues, but the Maryland Supreme Court reversed that ruling on September 3 and cleared it for the ballot. With Democrats holding supermajorities and the state’s partisan composition favoring passage of party-backed amendments, traders assign the measure a 71.5% implied probability of approval. Upcoming factors include any late organized opposition or turnout dynamics in the general election.
