Court records show the altercation began as a verbal dispute that escalated, with Eatherly allegedly firing multiple shots at Joshua Fox; both men were wounded. The case was bound over to the grand jury after a preliminary hearing where Eatherly entered a not guilty plea, and subsequent bond proceedings in May and June have kept him detained amid restrictions and a gag order. No trial date has been set, and no plea agreement or verdict has been reported. Traders appear to weigh the possibility of self-defense arguments, potential reduction to lesser charges such as aggravated assault, evidentiary review of surveillance footage, and the extended timeline typical for felony prosecutions as factors supporting a lower likelihood of conviction on the attempted murder count specifically.
