Republican National Committee have driven the 72% implied probability that SCOTUS will bar states from counting mail ballots received after Election Day. Conservative justices appeared skeptical that federal statutes setting the first Tuesday after the first Monday in November as Election Day permit grace periods for postmarked ballots arriving days later, with more than a dozen states maintaining similar receipt rules ahead of the midterms. A decision expected by late June or early July could require ballots to reach election officials by Election Day itself, prompting states to adjust timelines for voter access and administrative processing while preserving the uniform federal deadline.
